These Terms of Service (“Terms”) govern your access to and use of AntsData, including our website, APIs, account balance, datasets, dashboard, data delivery services, and related products and services.
AntsData is operated by FOXDATA (HONG KONG) TECHNOLOGY LIMITED. In these Terms, “AntsData”, “we”, “us”, or “our” refers to AntsData and FOXDATA (HONG KONG) TECHNOLOGY LIMITED.
By accessing or using AntsData, creating an account, using our APIs, submitting a data request, purchasing account balance, purchasing datasets, or otherwise using our services, you agree to these Terms. If you use AntsData on behalf of a company or other organization, you represent that you have authority to bind that organization to these Terms.
Your use of AntsData is also subject to our Privacy Policy and Acceptable Use Policy.
If you have questions about these Terms, please contact [email protected].
1. Our Services
AntsData provides data-related products and services, which may include APIs, account balance, top-ups, free trial balance, bonus or promotional balance, dataset products, custom datasets, managed data delivery, structured data outputs, dashboards, documentation, technical tools, sample data, support, and custom or enterprise data solutions.
The availability, features, pricing, supported sources, supported formats, service levels, limits, and delivery timelines of our services may vary by product, account, order, region, or agreement.
We may add, modify, suspend, or discontinue any part of the services, subject to applicable agreements and applicable law.
2. Eligibility and Business Use
AntsData is intended for business and professional use.
You represent that you are legally able to enter into these Terms, that you will use AntsData only in accordance with these Terms, our Acceptable Use Policy, and applicable law, and that all information you provide to us is accurate and complete.
If you use AntsData on behalf of an organization, you represent that you have authority to act on behalf of that organization.
3. Accounts, Credentials, and API Keys
You may need to create an account or receive API credentials to use certain services.
You are responsible for maintaining the confidentiality of your account, password, API keys, tokens, and credentials, and for all activity that occurs under your account or API keys.
You may not sell, share, transfer, expose, or misuse API keys or credentials except as expressly permitted by AntsData.
We may suspend, rotate, revoke, or limit API keys if we believe there is a security risk, abuse, non-payment, excessive usage, violation of these Terms, or violation of our Acceptable Use Policy.
4. Customer Data and Instructions
“Customer Data” means data, content, files, source information, URLs, keywords, field requirements, instructions, or other materials that you submit to AntsData or instruct AntsData to process.
You retain ownership of Customer Data you provide to us. You grant AntsData a limited right to process Customer Data as necessary to provide, operate, secure, support, maintain, improve, and bill for the services; comply with applicable obligations; and enforce our agreements.
You are responsible for ensuring that you have the necessary rights, permissions, authorizations, and lawful basis to provide Customer Data to AntsData, and that your instructions do not violate applicable law, third-party rights, platform terms, privacy rights, intellectual property rights, contractual restrictions, or our Acceptable Use Policy.
You may not submit sensitive personal information, credentials, private account data, confidential third-party data, or other data that you are not authorized to provide.
We may refuse, suspend, or limit requests that we believe create legal, technical, security, compliance, business, or reputational risk.
5. Acceptable Use
Your use of AntsData is subject to our Acceptable Use Policy.
You may not use AntsData for unlawful, unauthorized, harmful, abusive, deceptive, discriminatory, security-compromising, rights-violating, or otherwise prohibited activities.
Violation of the Acceptable Use Policy may result in suspension, termination, restriction of account balance, cancellation of dataset orders or deliveries, removal of access, refund ineligibility, or other actions described in these Terms and the Acceptable Use Policy.
6. Account Balance, Top-ups, Refunds, and Dataset Orders
Except where required by law or expressly agreed by AntsData in writing, payments are non-refundable.
AntsData may provide account balance, including paid balance, free trial balance, bonus balance, promotional balance, or other balance types. Account balance may be used for supported AntsData products and services, including APIs, datasets, custom datasets, and managed data delivery, subject to product availability, checkout information, order confirmation, offer terms, or applicable agreement.
Top-up bonuses, first top-up bonuses, promotional balance, or similar incentives may be issued as additional account balance or usage value. Bonus, free trial, and promotional balance have no cash value, are not refundable, are not withdrawable, and may not be exchanged for cash.
Paid balance does not expire monthly and remains available while your account is active, unless otherwise stated or required by law. Free trial balance, bonus balance, and promotional balance may have separate validity periods, usage conditions, or offer terms shown in the dashboard, checkout page, campaign page, order terms, or applicable agreement.
For a first self-service paid top-up, AntsData may approve a refund if all of the following conditions are met:
- the refund request is submitted within 7 days of purchase;
- no more than 20% of the paid amount associated with that top-up has been used, reserved, committed, or applied to any service or order;
- the payment was not made using cryptocurrency;
- the purchase was not an enterprise plan, manual quote, invoice order, custom order, dataset order, managed delivery order, or other non-self-service purchase;
- the account has not violated these Terms or the Acceptable Use Policy;
- there has been no chargeback, payment dispute, fraud, abuse, or suspicious activity related to the account or payment.
If a refund is approved, AntsData may refund only the unused and uncommitted paid amount from the applicable first self-service paid top-up. Free trial balance, bonus balance, promotional balance, and other incentives are not refundable. Any unused bonus or promotional balance associated with a refunded purchase may be cancelled.
Subsequent top-ups are not covered by the first self-service paid top-up refund policy and are non-refundable except where required by law or expressly approved by AntsData.
Cryptocurrency payments are not covered by the first self-service paid top-up refund policy and may be irreversible once confirmed on the applicable blockchain. Network fees, transaction fees, exchange rate differences, and third-party payment charges are non-refundable unless otherwise required by law or expressly approved by AntsData.
Dataset orders, custom datasets, managed data delivery, enterprise plans, manual quotes, invoice orders, and other non-self-service or separately agreed services are not covered by the first self-service paid top-up refund policy.
For dataset purchases, fees are generally non-refundable once the dataset has been delivered, downloaded, exported, accessed, or once AntsData has started collection, preparation, enrichment, cleansing, configuration, or delivery work.
After dataset delivery, you are responsible for reviewing and validating the delivered dataset within the applicable review period. Unless otherwise stated in the applicable order form or written agreement, the review period is 7 days from delivery. This review period is not a refund period and does not guarantee any specific remedy.
After the review period expires, AntsData does not guarantee continued storage, re-delivery, reproduction, or verification of the delivered dataset or related issues. AntsData may, at its discretion, review reported issues and provide correction, re-delivery, service credit, account balance adjustment, or another remedy where appropriate.
7. Pricing, Usage, and Billing
Pricing may vary by product, API type, endpoint, dataset scope, source, geography, volume, fields, frequency, delivery format, account type, support level, offer eligibility, campaign, checkout information, order terms, and other factors.
API rates may be product-specific and may differ across SERP, Scraper, Unlocker, or other APIs. API usage may be deducted based on product-specific meters, including successful searches, successful results, successful responses, requests, records, pages, or other applicable usage units.
Dataset pricing is quote-based unless otherwise stated. Dataset pricing may depend on sources, keywords, countries, fields, volume, time range, update frequency, processing requirements, delivery format, and managed delivery requirements.
Top-up bonuses, first top-up bonuses, promotional balance, effective usage costs, or similar pricing displays are estimates or promotional calculations unless expressly stated otherwise. Actual billing, usage deduction, balance application, and order charges are based on the product, meter, rate, checkout information, dashboard records, order confirmation, or applicable agreement.
You are responsible for reviewing pricing, usage, balance, bonus, offer terms, order terms, and billing information before making a purchase, using account balance, confirming a dataset order, or approving managed delivery work.
AntsData may correct billing errors, invoice errors, pricing mistakes, bonus calculation errors, balance errors, usage calculation errors, order errors, or display errors. If you believe there is a billing or usage issue, please contact us promptly at [email protected].
8. Service Delivery, Outputs, and Limitations
We aim to provide reliable services, but data availability, delivery time, output completeness, response time, and service performance may depend on third-party sources, network conditions, customer instructions, legal restrictions, anti-abuse systems, and other factors outside our control.
We do not guarantee that any specific third-party source will remain available, that data will be complete or error-free, that outputs will meet every business, legal, analytical, or operational need, or that third-party websites or platforms will permit access, scraping, extraction, or monitoring.
AntsData is not a cloud storage, backup, or long-term hosting service. Unless expressly agreed in writing, we do not guarantee long-term storage, retrieval, re-delivery, reproduction, verification, or backup of Customer Data, service outputs, API responses, delivered datasets, or related files.
You are responsible for downloading, storing, validating, and backing up outputs you need to retain.
9. Third-Party Sources and Services
AntsData may interact with, retrieve data from, or provide outputs based on third-party websites, platforms, sources, services, or public web content.
You are responsible for ensuring that your use of AntsData, your instructions, and your use of outputs comply with applicable laws, third-party terms, platform policies, privacy rights, intellectual property rights, and contractual restrictions.
AntsData does not control third-party websites, platforms, sources, or services and is not responsible for their availability, accuracy, restrictions, terms, or actions.
We may use third-party service providers for payment processing, hosting, analytics, customer support, scheduling, email delivery, security, advertising, CRM, and other business operations.
10. Privacy and Data Processing
Our Privacy Policy explains how we collect, use, disclose, retain, and protect information.
For enterprise customers or where AntsData processes personal information on behalf of a customer as a processor or service provider, the parties may enter into a Data Processing Addendum or similar data protection agreement.
If a Data Processing Addendum applies and conflicts with these Terms regarding the processing of Customer Data, the Data Processing Addendum will control to the extent of the conflict.
To request a Data Processing Addendum, contact [email protected].
11. Service Improvement, Automation, and Outputs
We may use usage, performance, diagnostic, aggregated, de-identified, or derived information to operate, secure, analyze, improve, and develop the services, including automation and model-related capabilities, subject to our Privacy Policy and applicable agreements.
You are responsible for ensuring that your use of AntsData in connection with AI systems, machine learning models, analytics, automation, or decision-making complies with applicable laws, third-party rights, and our Acceptable Use Policy.
Unless separately agreed, we do not grant you rights to use outputs in ways that violate applicable law, third-party rights, platform terms, privacy obligations, or intellectual property restrictions.
12. Intellectual Property
AntsData and its licensors retain all rights, title, and interest in and to our website, software, APIs, documentation, dashboards, technology, systems, designs, trademarks, service marks, and related intellectual property.
Subject to these Terms, we grant you a limited, non-exclusive, non-transferable, revocable right to access and use the services for your internal business purposes.
You may not copy, modify, reverse engineer, resell, sublicense, or create derivative works from AntsData technology except as expressly permitted by us in writing.
13. Outputs and Customer Use
Subject to your compliance with these Terms, applicable order terms, and payment obligations, you may use outputs delivered by AntsData for your internal business purposes or as otherwise agreed.
You are responsible for reviewing, validating, and determining whether outputs are suitable for your intended use.
AntsData does not provide legal, financial, compliance, investment, or professional advice. Outputs should not be treated as a substitute for professional judgment.
14. Feedback
If you provide suggestions, ideas, feature requests, or feedback, you grant AntsData a non-exclusive, worldwide, royalty-free, perpetual, irrevocable right to use, reproduce, modify, distribute, and incorporate that feedback into our products and services without restriction or compensation.
15. Confidentiality
Each party may receive non-public business, technical, pricing, product, or operational information from the other party.
The receiving party will use reasonable care to protect confidential information and will use it only for purposes related to the services, unless disclosure is required by law or permitted by agreement.
Confidential information does not include information that is public, already known without restriction, independently developed, or lawfully received from a third party.
16. Suspension and Termination
We may limit, suspend, or terminate access to AntsData, API keys, account balance, dataset orders, deliveries, or other services if you violate these Terms or our Acceptable Use Policy, payment fails or is disputed, we detect fraud or abuse, your use creates risk, or we are required to do so by law, regulation, third-party request, or platform restriction.
You may stop using AntsData at any time. Termination does not relieve you of payment obligations incurred before termination.
Certain provisions of these Terms will survive termination, including provisions regarding payment, refunds, customer responsibilities, confidentiality, intellectual property, disclaimers, liability, indemnification, and dispute resolution.
17. Disclaimers
To the maximum extent permitted by law, AntsData and its services are provided on an “as is” and “as available” basis.
We disclaim all warranties, whether express, implied, statutory, or otherwise, including warranties of merchantability, fitness for a particular purpose, title, non-infringement, accuracy, availability, reliability, and uninterrupted service.
We do not guarantee that the services, APIs, datasets, outputs, third-party sources, or delivered data will be error-free, complete, uninterrupted, secure, continuously available, or suitable for your intended purpose.
18. Limitation of Liability
To the maximum extent permitted by law, AntsData will not be liable for indirect, incidental, special, consequential, exemplary, punitive, or lost-profit damages, or for loss of data, loss of business, loss of goodwill, service interruption, or third-party claims, even if we have been advised of the possibility of such damages.
To the maximum extent permitted by law, AntsData’s total liability for all claims arising out of or relating to the services or these Terms will not exceed the amount you paid to AntsData for the specific service giving rise to the claim during the 3 months before the event giving rise to liability.
Some jurisdictions do not allow certain limitations of liability, so some limitations may not apply to you.
19. Indemnification
You agree to indemnify and hold harmless AntsData, its affiliates, officers, directors, employees, contractors, agents, and partners from and against claims, liabilities, damages, losses, costs, and expenses, including reasonable legal fees, arising from or relating to your use of the services, your Customer Data, your instructions, your outputs, your violation of these Terms or our Acceptable Use Policy, your violation of applicable law or third-party rights, or your misuse of APIs, datasets, account balance, credentials, or outputs.
20. Changes to the Services or Terms
We may update these Terms from time to time. If we make material changes, we may notify you by posting the updated Terms, updating the “Last updated” date, sending notice, or using other reasonable methods.
Your continued use of AntsData after updated Terms become effective means that you accept the updated Terms.
